“Practicing the gendered-FPIC
and non judicial conflict resolution in palm oil sector”
(Economic Justice Program)
Background
Over the past decade Oxfam has gained significant
expertise and influence in the area of sustainable palm oil. Oxfam has
been taking a holistic and rights based approach to palm oil projects,
with land use and land use change as the central focus. This connects local
beneficiaries of poverty alleviation and development with global goals
of climate change reduction and green growth. While Oxfam continues its
work on empowerment of Indonesian communities on land rights, sustainable
land use planning and labor rights, we believe there is an urgent need
for oil palm growers and millers to reconsider their relations with their
small holder supply base and surrounding communities, since these offer
the best potential for green growth with more efficient agricultural production
and avoided greenhouse gas emissions from further deforestation.
At least, since 2014 Oxfam in cooperation
with some CSO partners in Indonesia (KPA, SKPS and JKPP) have been initiating
an alternative governance model on palm oil plantation named FAIR (Freedom
of choice, Accountability, Improvement of benefits, Respect of rights)
and Green Growth.
Longer term objective of this initiative is
to develop company–community partnership models for exploitation-free
and deforestation free palm oil supply chains with a focus on economic
benefits for small holder families and protection of land rights of palm
oil communities.
A crucial component on this initiative is
on preventing and resolving the (potential) land conflict. We realized
that according to KPA’s data (2015), the most intense agrarian conflicts
were in the plantation sector, which was about 127 conflicts (50%). Furthermore,
the conflict in the infrastructure development sector occupied the second
highest with 70 conflicts (28%), and then 24 conflicts were in the forestry
sector (9.60%), and mining sector had 14 conflicts (5.2%), and other type
of conflicts had 9 conflicts (4% ), while agriculture and coastal /marine
sectors were in fifth rank respectively of 4 conflict (2%).
Dealing with this issue, Oxfam has been promoting
a non judicial mechanism as an alternative for resolving the conflicts.
Why non-judicial mechanism?
From formal aspect, the judicial process usually
are takes a long time and also very expensive. This is an obstacle for
those who want to seek justice, especially for community who are mostly
poor people who can’t afford to pay the court fee. Meanwhile, from material
aspect, the legal system in Indonesia is not sufficient to accommodate
people rights to land in traditional and customary tenure.
Why gendered-FPIC?
It is estimated that in Indonesia, the largest
palm oil producing country, over 1,5 million women work in the palm oil
sector, either as plantation workers on large scale schemes, in the households
of small scale producers and as women small holders. Small holders account
for 44% of the palm oil cultivated area in Indonesia and for 34% of the
production. Yet, gender issues in the palm oil industry are weakly covered
and are symptomatic for a broader tendency in Indonesia and other palm
oil production countries, to assume that at household level women and men
benefit equally from palm oil development. Both informally in Indonesian
society and formally in the internationally recognized standards, women
small holders and the wives of small holders are rather invisible and not
recognized as central economic actors.
Key Objective
To promote the gendered-FPIC and non judicial
mechanism especially on land conflict resolution in palm oil plantation
areas for private sectors.
Specific Objectives
1. To increase
understanding on the FPIC and land conflict in the oil palm plantations
areas in Indonesia and its potential solution with gender sensitivity.
2. To create
a joint frame-work on land conflict resolution in oil palm plantation
areas through non- judicial mechanism.
Expected Results:
1. Increased
understanding of company on the anatomy of the land conflict in oil
palm plantation areas and how to use FPIC to prevent the conflict with
gender sensitivity;
2. An overview
of opportunities for conflict resolution in the oil palm plantation areas;
3. A stakeholder
map who should be involved in the process of land conflict resolution in
the oil palm plantation areas through non- judicial mechanisms.
Tentative date and venue
The workshop will be conducted on 22nd
– 24th of November 2016in Jakarta
Responsibilities of consultant
1. To make
sure the workshop and training is running well by:
Ø Preparing
the venue, tools and methods with gender sensitivity for the workshop;
Ø Engaging
the targeted stakeholders to participate the workshop;
2. To facilitate
the workshop;
3. To develop
the activity report in English and submit it to Oxfam in Indonesia as scheduled.
Criteria for consultant,
1. Familiar
with palm oil issues with minimum 2 years experience on its labor rights.
2. Good understanding on climate change
reduction and green growth.
2. Excellent
understanding on FPIC and gender.
3. Fluent
in English written and spoken with good with good capacity in engaging
workshop & training participants.
4. Experience
on facilitating workshop and training at least with similar issues in economic,
SME, palm oil industry etc.
